                                ORDINANCE NO. 9720
        
        
                   AN ORDINANCE TO AMEND ORDINANCE NO. 8741,
                   ENCAPTIONED AS SET FORTH HEREIN, SO AS TO
                   REMOVE CONDITIONS SET FORTH THEREIN.

              	   WHEREAS, on December 23, 1986, the Board of
         Commissioners of the City of Chattanooga, Tennessee, enacted
         Ordinance No. 8741 encaptioned, "AN ORDINANCE TO AMEND 
ORDINANCE
         NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO
         REZONE A TRACT OF LAND LOCATED IN THE 2100 BLOCK OF GUNBARREL
         ROAD, BEING ON THE SOUTHEAST LINE OF GUNBARREL ROAD SOUTHWEST 
OF
         SHALLOWFORD ROAD, FROM R-3 RESIDENTIAL ZONE TO C-2 CONVENIENCE
         COMMERCIAL DISTRICT, UPON CERTAIN CONDITIONS"; and
              	   WHEREAS, it was the intent of the Board of
         Commissioners of the City of Chattanooga that said conditions
         would only be necessary until certain proposed improvements to
         Gunbarrel Road and Shallowford Road were completed; and
              	   WHEREAS, said conditions are no longer needed as the
         street improvements have been completed;
                                 NOW, THEREFORE,
              	   BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
         CHATTANOOGA, TENNESSEE, That Ordinance No. 8741, attached 
hereto
         and incorporated herewith, be and the same is hereby amended by 

         deleting Condition Nos. 1, 2 and 3 set forth therein.
              	   BE IT FURTHER ORDAINED, that this Ordinance shall take 

         effect two weeks from and after its passage, the public welfare 

         requiring it.
